Show Us Ur Kiss Contest Rules

1. "Contest Period" starts at 5:50pm on February 8, 2010 and continues until 11:59pm on March 7th, 2010 the "Contest Closing Date". No purchase necessary.  Any use of robotic, automatic, programmed or entry methods not authorized by these rules, shall be deemed as tampering and will void all of your entries.  All times are Eastern Standard Times.

(a) To enter, go to www.showusurkiss.com and upload any type of rich media - video, (no longer than two (2) minutes) digital picture, song, something visual, and complete the entry ballot in full and submit it as instructed by the Contest Closing Date.  This Contest is sponsored by Rogers Broadcasting Limited, the Contest Sponsor as represented by Kiss 92.5 ("Kiss 92.5").

NOTE that Kiss 92.5 may, in its sole discretion, elect to use, in whole or in part, any video or audio or any photograph entered into this promotion for its own future advertising and/or promotional activities, without notice or compensation; and that the person submitting same has no further copyright or similar claim.  Entrant warrants to Kiss 92.5 and affiliates that the submission does not contravene or infringe on anyone else's copyright or other intellectual property.

Submissions may not be for any other person, or include any other people in the video, must not contain defamatory words/statements (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, age, or socioeconomic group); may not contain material that is inappropriate, indecent (including but not limited to nudity or pornography, profane, obscene, hateful, tortuous, slanderous or libelous language or gesture), may not in any way reference persons or organizations without their written permission, may not include threats to any person, place, business, or group, must not disparage persons or organizations associated with Kiss 92.5; they must not invade privacy or other rights of any person, firm, entity, and they must not in any other way contain material that is unlawful, in violation of or contrary to all applicable federal, provincial, territorial, or local laws and regulations in any province or territory where video is created.

The submission cannot contain any unacceptable clothing or adornments, or display any commercial/corporate advertising, including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements as determined by Kiss 92.5, in its sole discretion. 

Kiss 92.5/judges reserve the right in their sole discretion to disqualify any entry that does not comply with the requirements of these Contest Rules.  Submissions must be suitable for presentation in a public forum, in sole determination of judges and/or Kiss 92.5.

(b) A panel of three (3) in-house judges will review all eligible entries received by the Contest Closing Date on or around March 10th, 2010, at One Mount Pleasant Road, Toronto, in order to choose ten (10) semi-finalists based on the following criteria:

1. Originality
2. Creativity
3. Look and feel of Kiss 92.5
4. Imagination

The ten (10) semi-finalists entries will be uploaded on www.showusurkiss.com whereas listeners may be able to vote once per day for their favorite entry, the voting will commence on 12:01pm on March 10, 2010, up until 11:59pm on March 19, 2010, the "Voting Period".  The semi-finalist with the highest number of votes at the end of Voting Period will be deemed the potential Grand Prize, winner, and the remaining nine (9) semi-finalists will be deemed the potential Second Prize Winners. In the case of a tie situation, a random draw will be conducted from the tied entries. Selected entrants will be contacted by telephone or email, as set out on the entry form, on or around March 22, 2010.
(c) If a selected entrant cannot be reached within 5 days following the draw, incorrectly answers the skill-testing question, declines the prize, or fails to return a Release of Liability as specified below, another entrant will be selected.

2. (a)  Participants are eligible to win:
   
   
   1. One (1) Grand Prize, consisting of a cheque in the amount of $5,000
   2. One (1) of nine (9) Second Prizes, each having an approximate retail value of $250 and consisting of Pizza Pizza for a year (one (1) Large 3 Topping Pizza each month for 12 months.

   Prizes must be accepted as described in these rules and cannot be transferred to another person, substituted for another prize, or exchanged in whole or in part, for cash, subject to the provisions set forth elsewhere in these rules.

   (b)  Prize must be accepted as awarded and may not be transferred or exchanged.  Kiss 92.5 reserves the right to substitute a prize of at least equal or greater value in the event of the unavailability, for whatever reason, of the advertised prize.
   

3.  To be declared a winner, selected entrants must first correctly answer, unaided; a time-limited, mathematical skill-testing question posed by telephone a mutually convenient time and will also need to return a signed release of liability and acknowledgment form.  Contest judges' rulings are final and without appeal in all matters related to the Contest and the awarding of prizes.
   
   
4. By entering this Contest, entrants consent to the use of their entry, name, city of residence and/or any photograph of or that may be taken in publicity carried out by Kiss 92.5 and its advertising agencies, without further notice or compensation.
    
   
5. This Contest is open to residents of Ontario who are 13 years of age or older excluding employees of Kiss 92.5, Pizza Pizza their parent and affiliated companies, representatives, dealers and agents, Contest suppliers and judges, and those with whom they are domiciled. The Contest is subject to all applicable federal, provincial and municipal laws and regulations. In the event the selected entrant is a minor, the entrant's parent or legal guardian will be deemed to be the entrant who must meet all contest eligibility requirements and who may accept the prize on behalf of the minor.
   


6. No communications will be entered into except with selected entrant. 
   


7. Odds of winning depend on the number of eligible entries.  All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Kiss 92.5.  Kiss 92.5 takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Kiss 92.5 is not responsible for any errors or omissions in printing or advertising this Contest.  All entries become the property of Kiss 92.5 and will not be returned.
   


8. Kiss 92.5 is collecting personal data about entrants for the purpose of administering this Contest.  No further informational or marketing communications will be received by entrants unless entrants provide Kiss 92.5 with explicit permission to do so as indicated on the entry form. Please see Rogers' Privacy Policy for information on its policy towards maintaining the privacy and security of user information.
   


9. By entering this Contest, entrants release and hold harmless Kiss 92.5, its advertising and Contest agencies and the Contest judge(s), their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the "Releasees") from any liability in connection with this Contest or, if declared a winner, the prize.  Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a Declaration of Compliance with the Contest Rules and a full Liability and Publicity Release.  By accepting a prize, winners consent to the use of their name, place of residence, voice, statements, and photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.
   


10. This Contest will be run in accordance with these rules, subject to amendment by Kiss 92.5.  Contestants must comply with these rules, and will be deemed to have received and understood the rules by participating in the Contest.  The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.


11. (a)  Kiss 92.5 assume no responsibility for failure of the internet or the website during the Contest Period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the Contest. 
    Kiss 92.5 reserve the right, in its sole discretion, to cancel, suspend or otherwise modify this Contest, cancel any method of entry or void any entries submitted fraudulently should unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of this Contest.  In the event of cancellation, Kiss 92.5 may elect to identify the winner and award the prizes by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws.  Should such an attempt be made, Kiss 92.5 reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. 
      
    (b)  If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant.  The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder.  A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry.  All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).
